Terms of Service

1. Acceptance of Terms

By accessing or using Car365 ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

Car365 is a peer-to-peer (P2P) marketplace connecting used car buyers and sellers directly. We provide vehicle listing, inspection, messaging, payment facilitation, and transaction management services.

3. User Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts to use the Platform. By registering, you represent that all information provided is accurate and complete.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Car365 reserves the right to suspend or terminate accounts that violate these terms.

5. Listing Rules

Sellers must provide accurate and truthful information about vehicles. Misrepresentation of vehicle condition, history, or specifications is prohibited and may result in account termination and legal action.

6. Inspection Process

All vehicles listed on Car365 must undergo the 150-point inspection by a Car365-certified mechanic. The inspection report is provided for informational purposes and does not constitute a warranty.

7. Fees and Payments

  • Inspection Fee: ₹2,000 payable by the seller at the time of scheduling
  • Success Fee (Seller): ₹10,000 payable upon successful sale completion
  • Success Fee (Buyer): ₹10,000 payable upon successful purchase completion

All fees are non-refundable except as expressly provided in our Refund Policy.

8. Transactions

Car365 facilitates transactions but is not a party to the sale agreement between buyer and seller. We do not guarantee the quality, safety, or legality of vehicles listed. Users transact at their own risk.

9. Dispute Resolution

In case of disputes between users, Car365 will attempt to mediate. Users agree to first attempt resolution through Car365's dispute resolution process before pursuing legal remedies. Disputes shall be governed by the laws of India and subject to the exclusive jurisdiction of courts in Mumbai.

10. Limitation of Liability

Car365 shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Platform. Our total liability shall not exceed the fees paid by you to Car365 in the 12 months preceding the claim.
